1. DEFINITIONS

  • Buyer.   The person who buys or agrees to buy the goods from the Seller.
  • Seller.   S Bartley T/A Thyme of 17 St Mary's Street, Stamford, Lincs, PE9 2DG.
  • Goods.  The articles which the Buyer agrees to buy from the Seller.
  • Price.    The Price for the Goods and any carriage, packing and insurance costs.
  • Conditions. The terms and conditions as set out in this document or any special terms and conditions agreed in writing between the Buyer and the Seller.

2. GOODS

2.1   The quantity, colour and size of the Goods shall be as set out in the Sellers confirmation of the order placed by the Buyer.

2.2   The Seller makes every effort where possible to provide accurate descriptions of the Goods advertised on the website.   Pictres displayed of Goods on this site may not be representatively in scale with each other.

2.3   The Seller makes every effort to keep stock quanties accurate on the website but is not liable for stock that has sold and become unavailable during update periods.

2.4   Where Goods become unavailble after placement of the order by the Buyer the Buyer will be conacted by the Seller and offered an alternative or a refund on the Goods unavailble.

2.5   Where Goods have been described as of assorted colours and/or designs they will be picked and dispatched at the discretion of the Seller.

2.6   Due to the nature of the production of some of the Goods offered for sale on this site there maybe naturaly occuring variations within these products.  Goods maybe produced from natural sources and/or hand finished and/or painted and died.  The Seller does not consider variations within these products as faults, please refer to section 7.5  for returns policy. 

2.7   The Seller reserves the right to remove from sale any Goods displayed on the website.

  3. PRICE

3.1  The Price shall be the amount as quoted on the website and on the Sellers confirmation of the order.

3.2   The Price of Goods quoted on the website may vary from that quoted elsewhere.

4. PAYMENT

4.1   Payment of the Price shall be due at the time of placing the order with the Seller and prior to the Goods being dispatched.

4.2   Payment via the website is taken by card payments via the secure payment site of  PAYPAL.

4.3   Payment can be taken by Credit/Debit Card by a representative of the Seller over the phone prior to the dispatch of the Goods..

4.4   Any other payment mehods must be authorized by a representative of the Seller and received prior to the dispatch of the Goods.

5. SHIPPING

5.1   Shipment of Goods and the carriage Price quoted is to an address within mainland UK. 

5.2   If shipment is required to an address outside of the mainland UK then a carriage Price and authorisation is required from a representative of the Seller before the Goods can be dispatched.

5.3   Carriage is charged on a weight basis the Price of which is displayed under post & packing on the checkout page of the website and added to the order.  Carriage is free on orders where the Price of the Goods purchased exceeds £150.00.

5.4   The Seller will make every effort to dispatch the Goods within 24 hrs for order received before 4pm, to be delivered to the Buyer 2 working days from dispatch of the order via an overnight carrier appointed by the Seller.

5.5   The seller will notify the Buyer that the Goods have been dispatched via email, phone or text.

5.6   It is the Buyer's responsibility to make arrangements to take delivery of the goods after notification of dispatch by the Seller.

5.7  The seller makes every effort to dispatch the goods within the agreed timescale but does not guarantee to do so due to outside forces.  Time of delivery shall not be of the essence of the contract.

6. ACCEPTANCE OF THE GOODS

6.1   The buyer is deemed to have accepted the Goods after delivery to the Buyer.

6.2   The Buyer is to carry out a thorough inspection of the Goods on delivery of the Goods and to notify a representative of the Seller within 5 working days of any discrepencies or defects of the Goods.

6.3    Where the Buyer has accepted, or has been deemed to have accepted, the Goods the Buyer shall then not be entitled to reject the Goods in accordance with the contract, other than due to subsequent fault.

6.4    The Buyer is to notify the Seller within 7 working days from notification of dispatch of the Goods that the Goods have not been received and to wait another 7 working days before replacements being dispatched

7. RETURNS

7.1   Goods are only to be returned after notification to the buyer and collection and collection costs arranged with the buyer.

7.2    It is the Buyers responsibility to ensure packaging of returned goods is adequate for shipment and to make available the Goods for collection.

7.3    Goods deemed to have been received faulty or damaged and the Seller has been notified (6.2) the collection of these Goods will be arranged with the Buyer.Upon return of the Goods, their inspection and agreement of fault by the Seller, note (7.6) (7.7)  (7.8), the Buyer will either be reimbursed the value of the Goods returned or resupplied with Goods returned as previously ordered.  Collection and shipment at the Seller's expense.

7.4   Goods retuned that prove not to be faulty, the Price will be reimbursed less collection costs.

7.5   Goods returned by the Buyer to the Seller as deemed by the Buyer to be not required shall be returned in their original packaging unopened, at the expence of the Buyer.  The Buyer will then be refunded the Price of the Goods returned but not the collection costs.

7.6   Goods returned as faulty due to natural varitions within their production will be reimbursed or resupplied at the discretion of the Seller.   Goods returned under these conditions and where the Seller does not consider the Goods to be faulty the Price of the Goods returned will be reimbursed less the collection costs.

7.7   The Seller will not consider Goods returned to be faulty if

  • batteries have been incorectly inserted and protective strips have not been removed from battery operated items. 
  • items that require building have not been put together correctly.

the Price of the Goods returned will be reimbursed less the colection costs. 

7.8    Items of clothing retuned faulty due to inncorrect size or colour will be resupplied to the Buyer in an alternative size or colour if available, only one alternative size and/or colour, at the discretion of the Seller or reimburse the Buyer the Price of the Goods.  Items of clothing that are available in one size only the Seller will reminburse the Buyer the Price of the Goods.  Collection costs and reshipping costs at the expense of the buyer.

8. CONDITIONS

8.1   These Conditions laid out above form the basis of the contract between the Buyer and the Seller in relation to the sale of Goods and are correct at the time of publication of the website and superseed any other terms previously issued.

8.2    All orders received by the Seller for Goods shall be deemed to be an offer by the Buyer to purchase the Goods from the Seller pursuant to these Conditions.

8.3   The Buyer is understood to have read and to have agreed to the above conditions when placing an order.

8.4   The Buyer should retain a copy of all  transactions and correspondance with the Seller.

8.5    The Buyer should contact the Seller details as displayed on the Contact page  or via email on the Enquiry page


Privacy Policy / Copyright

The Seller will not pass the details of the Buyer on to any third party without the Buyer's prior consent.

The Seller reserves the right to contact the Buyer at a future date unless the Seller receives a written request not to do so.

The Seller requests that viewers to the site do not download copies of images as they maybe copyrighted by the third parties that have supplied them to this site.
